By submitting an application, each Business and Owner/Partner (“Applicant”) agrees that:

2. Applicant will notify Lendtek of any material changes to business or financial condition.

3. Lendtek may share the application and related information with its representatives, affiliates, partners, third-party lenders/funders, servicers, and financial institutions (“Recipients”).

4. Lendtek and Recipients may obtain consumer reports, investigative reports, credit reports, bank statements, trade references, and any other information needed to evaluate the application.

5. Applicant waives claims against Lendtek, Recipients, and information-providers arising from obtaining or using this information.

6. The individual signing represents that they are authorized to submit the application for the business.

7. Applicant consents to receive communications regarding funding matters by email, phone, SMS, MMS, RCS, automated messages, and other electronic methods.

Submitting an application does not guarantee approval for any financial product. Lendtek may submit your file to multiple lenders, each of which may conduct their own credit checks.

 

2. PERSONAL INFORMATION WE COLLECT
We collect information from:

• Information you provide (name, address, phone, business details, documents).

• Information from your transactions (balances, bank data, payment history).

• Information from credit bureaus and third-party sources (creditworthiness, income data, payment history).

 

3. HOW WE USE AND SHARE YOUR INFORMATION

• Lendtek is not liable for lender decisions, credit impacts, or loss of business.

• Lendtek is not responsible for delays or failures caused by carriers, service providers, or third-party platforms.

• Lendtek does not guarantee approval for funding.

 

8. ARBITRATION & DISPUTE RESOLUTION (NEW YORK)
Any dispute, claim, or controversy arising out of or relating to your application, your use of Lendtek’s services, or these Terms shall be resolved exclusively through binding arbitration on an individual basis. Arbitration shall take place in the State of New York under the rules of the American Arbitration Association (AAA). You agree that all claims must be brought individually and not as part of any class, collective, or representative action. The arbitrator’s decision will be final and binding, and judgment may be entered in any court with jurisdiction. You and Lendtek both waive the right to a jury trial.

 

9. GOVERNING LAW
These Terms are governed by the laws of the State of New York.

 

10. CHANGES TO THESE TERMS
We may update these Terms at any time. Updates take effect upon posting on our website.
